This should be a minor problem
Today, I found much more serious ethical problem in the method how the medical data is obtained. In many states medical professional establish research databases without obtaining consent from the data subject. I absolutely oppose to give such right to the medical professionals.
Ethically absolutely opposed that a medical professional regrards medical data as his/her own property, and he/she can do anything with that. Never. The only ethical way is obtaining consent and give preliminary information. The Helsinki Decalaration sets out that in the preliminary information subjects must be informed about financial interest (if any). Sometimes research subjects may receive compensation. So, when later the private company makes a good money from the data, or tissue given by the subject I found it acceptable (since it was already known), and we should see the public good (the new knowledge may help to others in recovery) as well.
On the other hand I would give all rights to the patients to freely owe their personal medical data (and tissue) without any limits. Whoever obtains data without permission shall be seriousely sentenced (jailed).
