Depends
Question (a): Should depend on the situation and gravity of the threat involved. In an unusual situation, e.g. during an epidemic or pandemic, laws may be invoked (actually seen in certain countries) to put community interest above individual rights. But in usual cases, mutual respect for both sets of rights is desirable.
Question (b): About the statistical part of public health data, no need for privacy, non-disclosure, and confidentiality clause.
